1. Definitions

• "Platform" / "We" / "Us" refers to Bike Galaxy and its operators.
• "User" / "You" refers to any person who accesses the website or uses our services.
• "Seller" means a User who offers a two-wheeler for sale to us.
• "Quote" means the indicative price offered for a vehicle, subject to physical inspection.
• "Inspection" means the physical evaluation of a vehicle by our representatives.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law to use our services. By using the Platform, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Our Services

Bike Galaxy provides a service to purchase used two-wheelers from sellers located in Mumbai. Our process typically includes online valuation, a free doorstep inspection, a final price offer, and instant payment upon agreement. We currently operate in Mumbai only, and service availability may vary by location.

4. Valuation & Pricing

• Any quote provided online or over the phone is an indicative estimate based on the details you supply.
• The final price is determined only after physical inspection of the vehicle and verification of documents.
• The final offer may differ from the initial quote depending on the vehicle's actual condition, mileage, service history, accident history, and document status.
• You are under no obligation to accept the final offer, and we are under no obligation to purchase any vehicle.

5. Inspection

Inspections are offered free of cost at a location and time mutually agreed upon within our service area. You agree to make the vehicle and its original documents available for inspection. We reserve the right to decline a purchase if the vehicle or documents do not match the information provided.

6. Payment

Upon acceptance of our final offer and successful completion of documentation, payment is made via bank transfer, typically within 15 minutes. Payment timelines may be affected by banking hours, network conditions, or factors outside our control. Payment will be made only to the verified registered owner or an authorised representative with valid documentation.

7. Documentation & Ownership Transfer

• The Seller must provide genuine and valid documents, including the Registration Certificate (RC), valid insurance, PUC certificate, and a government-issued photo ID.
• The Seller authorises Bike Galaxy to initiate the transfer of ownership (RC transfer / NOC) after purchase.
• The Seller remains responsible for any challans, fines, liabilities, or legal issues arising before the date of sale.

8. Seller Warranties

By selling a vehicle to us, you represent and warrant that:

• You are the lawful registered owner or are duly authorised to sell the vehicle.
• The vehicle is free from any loan, lien, hypothecation, or third-party claim, unless disclosed in writing.
• The vehicle is not stolen and is not involved in any criminal or legal proceeding.
• All information provided about the vehicle is true and accurate to the best of your knowledge.

9. Prohibited Conduct

You agree not to misuse the Platform, including but not limited to providing false information, submitting fraudulent documents, attempting to sell a vehicle you do not own, interfering with the website's operation, or using the service for any unlawful purpose.

10. Cancellation

Either party may withdraw from a transaction at any time before final payment and completion of documentation. Once payment is made and documents are handed over, the sale is considered final and binding.

11. Limitation of Liability

To the maximum extent permitted by law, Bike Galaxy shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid or payable for the relevant vehicle transaction.

12. Indemnification

You agree to indemnify and hold harmless Bike Galaxy, its employees, and representatives from any claims, losses, or liabilities arising out of your breach of these Terms, your warranties, or any misrepresentation regarding a vehicle.

13. Privacy

Your personal information is collected and used in accordance with our Privacy Policy. We use your details solely to provide our services, process transactions, and communicate with you. We do not sell your personal data to third parties.

14. Intellectual Property

All content on this website, including the Bike Galaxy name, logo, text, graphics, and design, is the property of Bike Galaxy and is protected by applicable intellectual property laws. You may not copy, reproduce, or use any content without prior written permission.

15. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra.
